Domestic Violence Laws/Legal Help

It seems the last blog discussion has brought on a lot of questions and comments regarding U.S domestic violence laws. Here are some great resources to learn more about different laws and methods to fight domestic violence cases in court and some key questions and issues for discussion.

The following website is for an organization whose main mission is to provide easy-to-understand legal information to women living with or escaping domestic violence. Women’s Law

This resource links to information on every federal law and regulation applicable to violence against women: U.S. DV Laws and Regulations

It’s interesting (and somewhat saddening) to see that although the U.S has many resources and laws for dealing with domestic violence cases, the South Asian system lags far behind.  The most recent law I came across was the Protection of Women from Domestic Violence Act 2005, which was brought into force by the Indian government in October, 2006.

However, Bangladesh and Pakistan don’t seem to have vast legal structures set up for domestic violence, and I’m not quite sure how effective India’s legal laws are either.

Why is it that in South Asia, where domestic violence more heavily impacts everyday citizens, there is such a dearth of laws and regulations? Any thoughts? Also, if you have further knowledge or updates on legal reform, please do comment to educate and inform.

This is unrelated, but this is a blog post that all men (and women) should read.

Actually, Bangladesh has a very strict Nari Nirjaton Ain (Violence against women act). Any woman can file an abuse complaint against her husband/perpetrator and it enables authorities to arrest him immediately. It’s non bailable for 3 months, after which the High Court has to permit the alleged abuser to be bailed out. I’m not sure about enforcement and I doubt that women avail this opportunity but it’s still there. Better than nothing, if you ask me.
